Purpose of the Job:

The Departmental Head will be responsible for leading the development, implementation and monitoring of a departmental strategy and operational plan aligned with the strategic priorities of the Financial Sector Conduct Authority (FSCA) and the Conduct of Business Supervision (COBS) Division. The incumbent will also develop and implement an annual plan for supervising Financial Services Providers (FSPs), including Crypto Asset Service Providers (CASPs), in line with the FSCAs risk-based supervisory framework and overall COBS supervisory plan. The person appointed to this position will work collaboratively with other Departmental Heads in the COBS Division and report to the relevant Deputy Commissioner.

Requirements:

An appropriate Post-Graduate qualification in finance, commerce, accounting, audit, law, risk management, actuarial or related discipline with at least 12 years experience at a financial institution, supervisory agency or audit firm specialising in financial sector regulatory risk management, 8 of which must be in a management or senior management role, which included managing large and diverse teams. Deep understanding of the financial sector, various business models employed and the wide range of existing and emerging conduct risk issues, with a specific focus on the provision of financial advice, intermediation and distribution. The candidate must demonstrate the ability to lead inspection, supervisory, compliance monitoring or risk management teams in a financial services regulatory environment. In-depth knowledge of the financial sector regulatory landscape, including ongoing regulatory reforms, the Financial Sector Regulation (FSR) Act, No. 9 of 2017, the Financial Advisory and Intermediary Services (FAIS) Act, No. 37 of 2002 and developments relating to the future Conduct of Financial Institutions (COFI) framework is required.

Key Performance Areas:

  • Manage onsite and offsite supervision activities;
  • Oversee statutory reporting submitted by regulated entities;
  • Update supervisory colleges on key issues and emerging conduct of business trends to the extent applicable to the mandate of the FSCA;
  • Recommend regulatory action for material contraventions of applicable legislation;
  • Engage internal and external stakeholders to set and achieve strategic objectives including leading and co- ordination of supervisory activities and thematic projects;
  • Contribute to the FSCAs broader transition to an outcomes-focused approach to supervision;
  • Represent the COBS Division at relevant FSCA management and governance forums, including the Executive Committee (EXCO) and applicable EXCO sub-committees;
  • Represent the FSCA at various external forums, locally and internationally;
  • Prepare various supervisory and operational monthly, quarterly and annual update reports;
  • Prepare and manage the departments annual strategic and business plans as well as the budget;
  • Manage the performance and development of the team effectively and efficiently, and promote progressive talent and career development of staff; and
  • Perform such other tasks necessary or desirable to enhance the performance of the department and/or Division.
